Background information:

On March 9th, 2009, the plaintiff S.C. Romtelecom S.A. filed a complaint with the National Authority for Communications (ANC) against the respondent S.C. RCS & RDS S.A., requesting thereby to impose on the respondent the obligation to conclude an addendum to the interconnection agreement no. 204/02/1189/06.01.2004, for the purpose of opening the access to Romtelecom’s mobile network for the termination of the calls originated from RCS & RDS’s network and the termination on RCS & RDS’s network of the calls originated from Romtelecom’s mobile network.

As well, Romtelecom requested to impose on the respondent, as a provisional measure, the obligation to provide the aforementioned service until the resolution of the main issue by decision of ANC’s president.

In order to resolve the complaint, the plaintiff chose the contentious procedure.

The respondent’s request to impose provisional measures was settled by the ANCOM President’s Decision no. 197/2009.
