Background information:

 

On December 14th, 2009, the plaintiff S.C. ROMTELECOM S.A. (Romtelecom) filed a complaint with ANCOM against the respondent S.C. ORANGE ROMANIA S.A. (Orange).

 

The plaintiff asked ANCOM to impose on Orange the obligation to conclude an addendum to the existing interconnection agreement which should include the tariffs indicated by Romtelecom in the respective complaint, for the access to the single emergency call number 112 and to other national telephone numbers for emergency cases (Ambulance: 961, Police: 955, Fire Brigade: 981) between 1 September 2007 and 24 November 2008.

 

On February 19th, 2010, Romtelecom submitted a complementary request whereby it required ANCOM to oblige the respondent to pay the amount of 63,762.85 euros (i.e. 231,146.63 lei), representing the difference between the tariffs regulated by the Authority by way of the ANRCTI President’s Decision no. 2800/2007 for the service of call termination to the single emergency call number (112) and to other national telephone numbers for emergency cases and the amount paid by Orange in the 1 September 2007 – 24 November 2008 time frame, according to the tariffs set out by the parties in the Agreement.

 

In order to resolve its complaint, the plaintiff chose the contentious procedure.
