Description

On March 27, 2007, the plaintiff S.C. Net-Connect Internet S.R.L. (Net-Connect), registered in 1 Valea Calugareasca Street, block D5, appartment 13, Bucharest 6, submitted to the Regulatory Authority a complaint against the respondent S.C. Romtelecom S.A. (Romtelecom), registered in Bucharest, 1B Garlei street, sector 1, requesting thereby the following: the legal obligation of the respondent to offer the “successive billing” procedure for the payment of the countervalue due to the transit traffic realized between Net-Connect and certain providers, the establishment of the absolute nullity of the clauses regarding the tariff for the identification of the transit call comprised within the additional acts no. 204/02/8877/1/16.11.2004, no.204/02/9923/22.12.2004 and no.204/02/3426/15.07.2005 to the interconnection agreement no.204/07/167/05.08.2003 concluded between Net-Connect si Romtelecom, as well as the obligation of the respondent to refund the countervalue of the tariff for the identification of the transit call paid by the respondent during the period comprised between the date of filing the complaint and the date of settling the dispute. The complaint was registered at ANRCTI under no.7/201403/27.03.2007.

In order for its complaint to be resolved, the plaintiff chose the contencious procedure.

As well, Net-Connect, requested, as a provisional measure, the suspension of the enforcement of the marking tariff for the transit traffic until the judgement on the merits of the dispute.
