Background information:

On December 29th, 2008, the plaintiff S. C. Net-Connect Internet S.R.L. (Net-Connect) filed a complaint with the National Authority for Communications (ANC) against the respondent S.C. Romtelecom S.A. (Romtelecom).

Net-Connect requested thereby to impose on Romtelecom the obligation to conclude an addendum to the interconnection agreement concluded between the parties in 2003, which would provide the following tariffs for the interconnection service in view of call termination on the network of Net-Connect: 0.016 euros/minute – for calls made during peak hours (Monday to Sunday 12:00-24:00 hours), and, respectively, 0.005 euros/minute – for calls made off-peak hours (Monday to Sunday 24:00-12:00 hours), excluding VAT.

As well, the plaintiff asked to impose on Romtelecom the obligation to bear all costs pertaining to the provision by Net-Connect of associated interconnection facilities, based on to the proportion of traffic terminated by the respondent on the plaintiff’s network within the total traffic exchanged between the parties, at the tariffs provided by Romtelecom in the Reference Interconnection Offer.

In order to resolve the complaint, the plaintiff chose the contentious procedure.
