ANCOM submits to public consultation new regulations on end-user information obligations and other measures for protecting end-users

The National Authority for Management and Regulation in Communications (ANCOM) has launched for public consultation the draft decision on end-user information obligations and other measures for protecting end-users.

The  secondary regulations on the provision of information to end-users by the providers of publicly available electronic  communications services needs to be reviewed to bring it in line with the primary legal provisions, which have been amended following the adoption of  Law no. 198/2022  amending and supplementing certain regulatory acts in the electronic communications sector and establishing certain measures to facilitate the development of electronic communications networks, in order to transpose into the national legislation Directive (EU) 2018/1972 establishing the European Electronic Communications Code.

The draft decision is aimed at laying down obligations on the providers of internet access, voice communications, SMS and MMS services, and transmission services used for the transmission of audio-visual media services, regarding the information to be made available to end-users for them to be able to make informed decisions, the minimum information to be included in the detailed invoices issued to users, the format and modalities of notifying the providers' intention to unilaterally modify the contract, as well as the establishment of rules for granting compensation to subscribers affected by breach of the legal obligations with respect to switching fixed internet access service providers.

The interested persons are invited to send comments and proposals by  16.01.2023, to the ANCOM headquarters (2 Delea Nouă Street, sector 3, Bucharest), through Online registry or through the Authority's regional divisions.
