Digital Services Law: public consultation on the information procedure applicable to the providers of intermediary services containing clarifications

After the entry into force of Law no. 50/2024 on establishing measures for the application of the Regulation 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services and amending Directive 2000/31/EC, as well as for amending and completing Law no. 365/2002 on electronic commerce, ANCOM is consulting all interested persons on the draft decision on the information procedure applicable to the providers of intermediary services, which contains clarifications necessary for a better understanding of the scope of the Decision.

Law on digital services in Romania

With a view to implementing the DSA provisions in Romania, the Ministry of Research, Innovation and Digitalisation together with ANCOM have put forward the Law no.50/2024 laying down the national legislative measures required to enforce the provisions of the European act. The normative act, published into Romanian Official Journal no.232 of 19 March 2024 and effective from 22 March 2024, designates the National Authority for Management and Regulation in Communications as Digital Services Coordinator. ANCOM is responsible for all aspects related to the supervision and ensuring of compliance with the Digital Services Act.

The public consultation

The draft decision on the information procedure applicable to the providers of intermediary services and on amending and completing the Decision of the president of the National Authority for Management and Regulation in Communications no. 336/2013 on the means for the providers’ submission of certain documents, data or information to the National Authority for Management and Regulation in Communications, already at the disposal of interested parties  as of 5 March 2024, is available for consultation here. The interested persons are invited to send their comments and suggestions by 08.04.2024, to the ANCOM headquarters (2 Delea Nouă street, sector 3, Bucharest), via the Online Registry or through the Regional Divisions of the Authority.
