How can the contract for telephony, internet or television services be amended?

Telephony, internet or television contracts may be amended both upon the user’s request, under the terms provided in the contract or based on direct negotiation, and upon the provider’s initiative. According to the legal provisions, where an operator intends to unilaterally amend the contract concluded with an end-user, the latter has the right to terminate it, without paying penalties, within 30 days from receiving the notification on the contract amendment, if he/she does not agree on the proposed amendments.
According to ANCOM President’s Decision no.158/2015 on the providers’ obligations to inform the end-users,the notification on the intention to unilaterally amend the contract must be transmitted by letter, e-mail, SMS, fax or by means of the subscriber’s account on the provider’s website, in the latter situation the notification being accompanied by an SMS and/or a warning e-mail on the sending of such a notification.
Irrespective of the manner in which the operator sends the notification, it must ensure that the full text of the notification has been sent, without any links to other sources of information. Moreover, where the notification is sent on paper support, this must be separated from all advertising material.
According to the same ANCOM decision, the providers of telephony, internet and television services in the Romanian market have the obligation to publish on their websites information on the conditions for amending the contract, including the steps the users must take in order to request the contract amendment.
Where a provider has amended the contract without notifying the users or it has not informed the users on the right to terminate the contract without penalty, by means of notification, ANCOM may take measures. Complaints may be sent here. The users can find additional details on the contracts concluded with the providers and on the information the providers have the obligation to publish on their websites by means of the InfoCentre section on the ANCOM website.
 
Read what you are signing!
Before signing a contract, a user should ask for a copy of the Framework-contract, which contains all the general provisions applicable in their relationship with the service provider, irrespective of the offer actually chosen by the user. This document is also available on the provider’s website and must be considered before signing a contract.
