How can I cancel a porting request

Following the complaints received by ANCOM, the Authority brings to the users’ attention the fact that only the applicant can cancel the process of porting a telephone number, by submitting a request to the provider to whose network he/she intended to switch, no later than 24 hours before the time initially agreed for completing the porting process.
 
Porting cancellation
The porting process may be cancelled by submitting an application therefor to the acceptor provider’s sale point where the porting request has been filed or to the acceptor provider’s closest work station. The standard form to be filled in order to initiate the cancellation of the porting process is available at the acceptor provider (the new provider) or on www.portabilitate.ro. 
When a user takes the decision to give up the porting process, he/she must be aware of the very short time interval available for initiating the cancellation. The cancellation application must be submitted no later than 24 hours before the time initially agreed for completing the porting process.
If a cancellation application is submitted less than 24 hours before the moment initially agreed for the porting completion, the telephone number will be ported.
It is noteworthy that the porting interval usually spans 3 working days, so - if the initially agreed porting time is to be on Monday - the cancellation application must be submitted on the preceding Friday.
 
Provisional number
During the porting process, the provider on whose network the number is to be ported may assign the user a provisional telephone number, enabling the earlier use of the new services. However, the acceptor provider must ensure the user’s possibility to port his/her telephone number without a provisional number, as well.
Where a user agrees to be assigned a provisional number, two options are available to him/her in the event the porting is not carried through: either continue the contractual relationship with the acceptor provider based on the provisional number (i.e. conclude a contract with this provider, as well) or give up the provisional number and – implicitly – the contract it involves. Whenever a user submits a porting request, the acceptor provider has the obligation to inform him/her on these options (usually, as contract provisions). 
 
Obligations of the providers involved in the porting process
Telephony operators must provide the users, free of charge, all the details regarding the porting process by means of the Customer Services, on their own website. Moreover, operators have the obligation to make available to the users porting request standard forms, at their sale points, alongside the procedure for the submission, validation and cancellation of porting requests.
 
User complaints
In the first five months of 2019, ANCOM received 40 complaints on porting cancellation issues and on the assignment of a provisional number.
During 2018, ANCOM received 568 complaints on the porting process. The main issues were failure to exchange messages between the providers’ data bases, rejection of number transfer and assignment of provisional numbers.
A great number of users that complained to ANCOM requested the cancellation of the porting process. We emphasize that ANCOM is not in the position to cancel a porting process, as only the parties involved in this process can take steps therefor.
Thus, ANCOM recommends the users to read in detail the contracts to be concluded with the telephony providers, paying special attention to the telephone number porting process, and also to ask for and keep their copies of the documents (porting requests, cancellation requests, contracts etc.) signed with the acceptor provider.
