ANCOM Submits to Public Consultation 2013 Action Plan

The National Authority for Management and Regulation in Communications (ANCOM) has published today for public consultation its proposals for the 2013 Action Plan.
2013 will bring important changes to the telecommunications industry, generated by the adoption in the last quarter of 2012 of the law on the regime of the infrastructure of electronic communications networks. The new legal framework contains provisions regarding the establishment of a transparent and non-discriminatory procedure for the conclusion of the agreements granting access on public property, and regulates the procedure for the conclusion of these agreements as well as the means in which the right of access on a property may be exercised following the conclusion of such an agreement and the access to the infrastructure of the electronic communications networks, including its shared use.
This law establishes a series of tasks for ANCOM such as: hold the inventory of the public electronic communications networks and associated infrastructure facilities, create a database containing the conditions of access on the public property of the state or of the administrative-territorial units and the agreements concluded therefor, elaborate a guide to the technical and economic requirements to be met in order to achieve access to the infrastructure of the providers of electronic communications and elaborate a standard-agreement for access on private property in view of installing, maintaining, replacing or moving public electronic communications networks or infrastructure facilities, and undertake control actions for verifying compliance with the obligations incumbent on public authorities in the light of the new legal provisions.
In order to support all those covered by the provisions of this law, respectively providers, owners and public authorities, and given the major changes provided thereunder with regard to the access on properties and infrastructure shared use, next year ANCOM will run an information campaign thereon.
Likewise, the modelling of efficient cost for the provision of interconnection services in view of call termination, origination and switched national transit at fixed locations and of termination at mobile locations, for ancillary services, Ethernet backhaul services and leased lines-terminating segments with the capacity up to including 2 Mbps (provided over a transmission network) will be completed in 2013.
In order to help the end-users to make well-informed decisions and obtain maximum of benefits on a competitive communications market, ANCOM will complete in 2013 the implementation of two important projects: the online application for comparing the communications offers intended for the end-users, financed from European funds, and the online application for measuring the quality-of- service technical parameters for Internet access.
In relation to the same topic, the Authority will elaborate a draft decision establishing the quality parameters for the provision of linear audiovisual media programme retransmission services and/or the broadcasting of audiovisual media programme services on request to the end-users.
Moreover, the Authority will elaborate a guide regarding the conclusion and minimum provisions of distance contracts covering the provision of publicly available electronic communications services with a view to clarify the providers on how to interpret and implement the specific legal obligations in the electronic communications field.
ANCOM also plans to amend the relevant secondary legislation in the radio spectrum field, by reviewing the authorisation procedure for the provision of audiovisual programme services and the procedure for requesting and issuing licences for the use of radio frequencies and numbering resources, and update the National Table for Frequency Allocations in line with the international provisions in force. Furthermore, the strategies on the use of the frequency bands above 40 GHz allocated to the fixed service, the implementation and development of BWA systems in the 3400-3800 MHz band for 2011-2020 and the award of the usage rights for the 450 MHz band will be elaborated. The Authority also intends to hold in 2013 a public consultation on the future use of the frequency blocks which were not assigned within the spectrum auction held in 2012.
As for the postal market, ANCOM is planning to review the decision on the general authorisation regime in the postal field, as well as to monitor the compliance by the postal providers with their obligations in relation to the users. Given that the capacity as a universal service provider of CNPR expires at the end of this year, ANCOM will assess this market in order to determine whether the postal services within the scope of universal service may be offered through market mechanisms and then establish the opportunity of designating a new universal service provider.
In order to contribute to preventing the occurrence of network security incidents, the Authority intends to finalise a draft decision establishing the minimum security measures to be taken by the providers of electronic communications networks and services and on the reporting of the incidents with significant impact on the provision of electronic communications networks and services, and to elaborate a guide to the implementation of these measures.
In the second half of the next year, ANCOM will host the plenary meeting of FRATEL, an organisation founded in 2003 by the regulatory bodies from the French-speaking countries for strengthening the cooperation and exchange of information among its members and thus contribute to finding the best solutions to common telecom regulatory topics. In October 2012, the ANCOM President was elected Vice-Chairman of FRATEL for one year.
