ANCOM proposes updating regulations concerning people with disabilities

ANCOM launches for public consultation a draft decision updating the regulatory measures addressed to people with disabilities, taking into account both the legislative changes envisaged by the draft legislative acts transposing the European Electronic Communications Code and Directive (EU) 2019/882 on the accessibility requirements for products and services, as well as the volatility of the offers regarding the electronic communications services as a result of the change of the consumption behaviour of the users and, implicitly, of the demand.
 
Proposed changes
The draft decision proposes a series of measures designed for end-users with disabilities in order to ensure their optimal access to electronic communications services, and a high level of information, is such a way as to meet their needs.
 
Taking into account the need to adapt the tariff plans available on the market to the consumption needs of people with vision, hearing and/or speech disabilities, the Authority proposes two configurations of service packages containing a minimum level of consumption units, at maximum recommended rates to be charged by providers.
 
Thus, for end users with hearing and/or speech disabilities, ANCOM proposes making available mobile service packages with an unlimited number of SMS on the providers’ individual networks and 300 SMS on national networks, at a recommended rate of 4 euros/month, including VAT, and - upon the user's request -, a data volume of 5 GB, at a recommended rate of 2 euros/month, including VAT, the total recommended package tariff being 6 euros/month, including VAT.
 
For end-users with vision disabilities, ANCOM proposes the configuration of mobile service packages containing 2,000 minutes on the providers’ individual networks and 500 minutes on national networks, at a recommended rate of 2 euros/month, including VAT, and - upon the user’s request -, a data volume of 5 GB, at a recommended rate of 2 euros/month, including VAT, the total recommended package tariff being 4 euros/month, including VAT.
 
Other measures tailored for people with disabilities
Moreover, the draft decision aims to increase the level of information among people with disabilities, as well as to support them in accessing electronic communications equipment, based on their specific needs.
 
Thus, at the request of disabled end-users, the providers are obliged to offer them information materials in a format that is accessible and relevant to people with disabilities, which clearly set out the functions and ways in which the respective terminal equipment can meet their needs.
In order to maximize the disabled end-users’ access to public electronic communications services, the providers will have to offer them a minimum set of details about the services provided, through specific ways tailored to the needs of the respective users.
