ANCOM Proposes Changes to Secondary Legislation in Numbering and Technical Resources Field

The National Authority for Management and Regulation in Communications (ANCOM) has submitted today for public consultation a draft decision amending and completing certain regulations in the field of numbering resources and technical resources and a draft decision on the use of the internal national short numbers and of the SMS/MMS short codes.
The amendments and completions are triggered by the entry into force of the new primary legal framework in the electronic communications sector and refer to the National Numbering Plan (NNP), the procedure for requesting and issuing the licence for the use of numbering resources, respectively the procedure for the allocation and use of certain technical resources, as well as the usage conditions for the 19vx(y) or 118(xyz) national short numbers.
Concerning the NNP, ANCOM proposes to modify the status of the national short numbers in the 12vx(y), 14vx(y) and 15vx(y) range, and introduce new categories of national short numbers of 83vx(y), 84vx(y), 88vx, 96vx(y) - 99vx(y) type. These may be used to provide network specific services and value added services. Furthermore, the Authority proposes that the 0Z=06 domain be used for electronic communications services provided at mobile locations due to the development of these services and to the high usage of the numbering in the 0Z=07 domain.
The main changes to the procedure for requesting and issuing the licence for the use of numbering resources (LURN) concern granting to the providers of public electronic communications networks the possibility to obtain the right to use certain categories of numbering resources, regulating the conditions for achieving the direct transfer of the numbering resources to a provider of publicly available electronic communications services and loosening up the conditions for the allocation and transfer of the numbering resources.
Taking account of the need to open access to numbering resources for all the providers that can contribute to ensuring publicly available electronic communications services, the draft decision submitted to consultation proposes that the providers of public electronic communications networks be allotted, licence-based, geographic numbers, location-independent numbers or non-geographic numbers for electronic communications services provided at mobile locations. Thus, these providers obtaining the right to use the aforementioned numbering resources may further transfer them to the providers of publicly available electronic communications services hosted on their networks, including mobile virtual network operators. In line with the new legal framework in the field, the draft decision brings the possibility to regulate the direct transfer of the numbering resources allotted to a holder, without the need to undergo the procedure for requesting and issuing a new licence for use of the numbering resources. As well, based on the experience acquired in the management of the numbering resources, ANCOM introduced in the draft decision a series of measures meant to simplify the procedure for awarding a licence for the use of numbering resources and proposes the extension to 12 months of the activation time, to ensure a sufficient time interval for negotiating and concluding interconnection agreements.
The Authority also proposes to enlarge the scope of services that can be provided by means of the 19vx or 19vxy numbers, by including a new category of services – general interest services, the providers being able to charge different tariffs in keeping with the sub-domains used.
The draft decision on the use of the internal national short numbers and of the SMS/MMS short codes aims at determining certain numbering resources standing for national short numbers included in the NNP and used for the provision of valued added services and network specific services. This draft decision envisages the regulation of the specific rights and obligations of the providers using or assigning these resources to third parties, and a series of general usage rules. The providers will have at their disposal, for the SMS/MMS-based exclusive access services, additional special domains intended for SMS/MMS short codes, which are subject to the same general usage rules. The format of these codes will be later established by means of a Conduct Code adopted by the providers of public electronic communications networks, LURN holders, using or assigning national short numbers and SMS/MMS short codes.
