The indicative tariffs for access to network operators’ poles have been set

ANCOM adopted, following discussions with industry representatives in the Advisory Council, the decision on setting the indicative tariffs access network operators’ poles. Setting the indicative tariffs for access to the network operators’ poles is an important step in implementing the provisions of the Infrastructure Law, providing key guidance in the negotiation of contracts. The tariffs set by ANCOM can contribute mainly to simplifying negotiations between the parties, as well as to fostering the deployment of electronic communications networks and of the associated physical infrastructure elements.
 
The indicative tariffs set by ANCOM
Thus, the following indicative tariffs have been set for the public electronic communications network providers’ access to the physical infrastructure consisting of poles owned, administrated or held as a concession by electricity distribution operators:
a) 2.05 RON/pole/cable/month, for the poles supporting low-voltage overhead power lines;
b) 3.51 RON/pole/cable/month, for the poles supporting medium-voltage overhead power lines;
c) 28.55 RON/km/cable/month, for the poles supporting high-voltage overhead power lines.
The indicative tariff set for the public electronic communications network providers’ access to the physical infrastructure consisting of poles owned, administrated, or held as a concession by operators of the local public transport service is 7.44 RON/pole/cable/month. The indicative tariffs do not include VAT and can be indexed to the inflation rate on a yearly basis.
 
How the tariffs have been set
ANCOM has identified the main network operators that own, administrate, or hold as a concession, poles that are/could be used by the providers of public electronic communications networks for the installation of public electronic communications networks and has calculated access tariffs for the categories of network operators that are electricity distributors, respectively operators of the local public transport service (trolleybus and/or tramway).
The indicative tariffs for access to the poles of network operators have been calculated taking into account cost-orientation principles and methodologies in line with the European costing practice - the cost-causation principle, the principle of objectivity and the principle of proportionality.
ANCOM identified the costs associated with the provision of the infrastructure access service, taking into account both the network operator’s own investments in deploying the physical infrastructure subject to access and the costs incurred to provide such access, while assessing the impact of the requested access on the network operator’s business plan and the improvements brought to the physical infrastructure by the electronic communications network provider, to the extent they also benefit the network operator, for each of the identified network operator categories.
The decision enters into force on the date of publication in the Romanian Official Journal, Part I.
