Reviewed General Authorisation for The Provision of Electronic Communications Networks and Services, Agreed with The Industry

Today, the National Authority for Management and Regulation in Communications (ANCOM) has agreed with the profile industry the draft of a new decision on the general authorisation regime for providing electronic communications networks and services. Thus, the objective of transposing the provisions of the new regulatory framework into the secondary legislation has been accomplished. In principle, important issues regarding the security and integrity of the electronic communications networks and services, the provision of electronic communications networks and services under special circumstances, the terms of use of the numbering resources, the technical conditions applicable to the services of audiovisual programme retransmission, as well as regarding the content of the description file of the networks and services have been clarified, amended and completed.
The decision approved today paves the way to ensuring a higher level of security and greater transparency in establishing electronic communications, both by enhancing the providers’ responsibility related to the security and integrity of the electronic communications networks and services, and by informing the users as regards security incidents.
Moreover, the obligations regarding the implementation of steps tailored to ensure network integrity and the continuity of the provision of electronic communications services under special circumstances that could pose a significant threat to human life or health will apply to all the providers, so that communications between the authorities entrusted with disaster mitigation could also be facilitated.
The normative act adopted today opens the public electronic communications providers’ possibility to benefit from the right to use certain numbering resources.
With regard to the services of linear audiovisual media programme retransmission, a set of measurable specific technical parameters according to the standards in force has been agreed with the industry, with a view to protecting the end-users’ interest.
The new decision brings further amendments and completions to the procedure of sending the notification for the provision of electronic communications networks or services. Thus, a new exemption from this obligation enters into force, through new clarifications on the terms for observing the notification obligation by the foreign entities that intend to provide electronic communications networks or services in Romania. The above-mentioned exemption is applicable to operators of global mobile personal communicationsby satellite (G-MPCS/S-PCS) and is aimed at lightening the administrative burden levied by the Romanian state for the purpose of including the national territory in the coverage of the electronic communications networks that ensure cross-border electronic communications services, so that the end-users of satellite communication services could benefit from these services also while transiting the Romanian territory.

Upon completion, the decision will be sent to the Romanian Official Journal for publication.
