New Procedure for the Designation of Universal Service Providers in the Postal Sector

The National Authority for Management and Regulation in Communications (ANCOM) has discussed today with the industry upon the decision on the conditions and the procedure for the designation of the universal service providers in the postal field. Under the new decision, the Authority will designate upon request or ex officio, for maximum 10 years, one or several universal service providers, for the entire national territory or for different parts thereof.
Any provider of postal services authorised to provide the services within the scope of universal service may be designated as a universal service provider by ANCOM, upon request or ex officio, if there are no requests therefor. The universal service provider is to be designated for a timeframe sufficiently long as to ensure the economic viability of the provided services, which however will not exceed 10 years. ANCOM will be able to designate one or several universal service providers to provide one or several services within the scope of universal service, for the entire national territory or only for a part thereof, with a view to ensure full coverage.
The net cost will be compensated only at the request of the universal service provider and the compensation will be financed from a universal service fund administered by ANCOM. In the event the collected amount is insufficient, the difference between the net cost to be compensated and the collected amount will be covered from public funds.
The net cost of the universal service provision represents the losses registered by the designated provider upon fulfilling the universal service obligations. 
Furthermore, the scope of the universal service was amended. Thus the direct mail services were removed from the scope of universal service while the cecogramme provision service was included therein.
At present, the right to access the universal service is ensured across the country by the Romanian Post National Company (CNPR), which holds the capacity as a universal service provider until 31 December 2013.
The decision ANCOM adopted today transposes the provisions of Government Emergency Ordinance no.13/2013 on postal services, approved with amendments and completions by Law no.187/2013, which brought a series of amendments to the previous legal framework. Thus, under the primary legislation, aspects such as the designation of the universal service providers, the scope of postal services subject to universal service, the mechanism for financing the net cost, as well as the rights and obligations of the universal service providers have been amended in keeping with the Community provisions in the field.
Access to the universal service is the right of every citizen to benefit from the uninterrupted provision of basic postal services, at affordable prices for all users and at a certain quality level, in any location on the territory of Romania. The designated universal service provider/providers has/have the obligation to provide services at affordable tariffs on the entire territory for which they were designated, including in the areas located in exceptional geographic conditions or with low density population, where the correspondence volume is low and therefore the activity can be non-profitable.
The decision on the conditions and the procedure for the designation of the universal service providers in the postal field will be sent to the Romanian Official Journal, for publication, and will come into force three days after publication.
