More than 6,000 Control Actions in the Market of Communications and Postal Services, in 2015

”In order to ensure the smooth development of the sector in Romania and the electronic communications and postal service providers’ compliance with the legal provisions, ANCOM conducted 6,223 control actions in 2015, resulting in 338 notifications transmitted to providers, 797 warnings and 96 fines imposed, amounting to RON 449,400.”, declared Cristin Popa, Director of the Monitoring and Control Executive Division of ANCOM.
In the market of electronic communications and radio equipment / telecommunications terminals, ANCOM carried out 4,902 control actions in 2015. Thus, ANCOM issued 332 notifications, applied 675 warnings and enforced 73 fines, amounting to RON 383,900.
Among these, 29 fines amounting to RON 194,000 were enforced on CATV providers for breach of the conditions provided in the General Authorisation, 19 fines amounting to RON 87,900 - on holders of licences for the use of radio frequencies that failed to observe the conditions in the authorisation documents or misoperated the radiocommunications stations, and 19 fines amounting to RON 70,000 were enforced on manufacturers, importers and distributors of radio equipment and terminal telecommunications equipment. ANCOM enforced the rest of the sanctions on the providers of television and sound broadcasters (RTV), respectively on the providers of data transmission and internet access providers.
The largest fine in the Romanian communications market, amounting to RON 30,000, was enforced by ANCOM on the company Alden Media SRL, for the provision of CATV services by means of an MMDS-type network without a licence for the use of radio frequencies, following repeated infringements. According to the legislation in force, radio frequencies can be used only upon ANCOM’s issuance of a corresponding licence (certain frequencies established by the law are excepted), under conditions that ensure the efficient use of radio frequencies, avoidance of occurring harmful interferences, and the technical quality of the provided service.
In 2015, ANCOM conducted a campaign for verifying the electronic communications providers’ compliance with the obligations provided in ANCOM’s decision no. 158/2015 on informing the users. Where the providers were found in breach of the obligation to publish on their websites information, for example, on the available tariff plans, their price or the included resources and equipment, or information on the contract duration, the framework-agreement, service coverage and the complaint handling procedure, the Authority notified 75 providers and applied 75 contravention fines by warning, following the breaches assessed.
In the postal services market, in 2015, ANCOM conducted 1,321 control actions, issuing 6 notifications and applying 122 warnings and 23 fines, amounting to RON 65,500, the most breaches assessed concerned failure to observe the obligations imposed by the general authorisation regime. Among the control actions in the postal services market, 601 were conducted on the National Company “Poșta Română” (CNPR) as a universal service provider. Following these, ANCOM applied one notification, 47 warnings and 9 fines amounting to RON 28,000.

 

The largest fine in the postal services market amounted to RON 10,000 and was enforced on CNPR, for failure to measure and report– as per the incumbent obligation –, between July and December 2014, the quality parameters provided by legislation in the field of postal services, i.e. the delivery timeframes for the domestic items of priority correspondence weighing up to 2 kg.For the services under this category, CNPR has the obligation to deliver 85% of all the postal items within one working day from the date of their depositing at the access points, respectively 97% of all the items within two working days since that date.
