Public consultation on the technical conditions regarding the use of mobile communications networks in respect of their connection with the RO-ALERT System

The National Authority for Management and Regulation in Communications (ANCOM) launches for public consultation a draft decision setting out the technical conditions regarding the use of the mobile public electronic communications networks and their connection with the RO-ALERT system in order to transmit population warning messages.

Obligations of mobile telephony providers regarding the connection with the RO-ALERT System
The operators will ensure connection between their networks and the RO-ALERT system at the STS premises in Bucharest and Brașov. The draft normative act also regulates the situation in which changes occur regarding the premises where the connection is achieved, providing a period of 6 months from the receipt of an official STS notification within which the providers of the mobile public electronic communications networks - upon STS’ request - have the obligation to carry out the connection of their own networks with the RO-ALERT System at the new premises.
Obligations of mobile telephony providers regarding the transmission of RO-ALERT messages
The operators will send such messages by means of communication controllers, at the level of all the radio cells indicated by the RO-ALERT System, in their own networks, in all the available technologies, in the shortest possible term.
Public warnings must reach all end-users in the geographical areas affected by emergencies; therefore it is important to have a confirmation of the radio cells in the affected areas that have transmitted the RO-ALERT message. To this end, the operators will send a confirmation message regarding these cells within 3 minutes from the moment of sending the initial message.
With a view to meeting these obligations, the operators will consider the latest technologies available for network elements, as they need to perform all hardware/software updates in order to retrieve RO-ALERT messages and distribute them to all radio cells within their own networks.
Furthermore, the draft normative act regulates the possible occurrence of malfunctions in the distribution of RO-ALERT messages, as it sets the maximum terms within which these occurring malfunctions must be remedied. In this respect, a maximum 8-hour period was stipulated for the operators to take all the necessary measures in order to remedy the malfunctions of the communication controllers, respectively a maximum 24-hour period for them to remedy the malfunctions of the radio cells. Moreover, they must have a dedicated technical support centre that operates 24/7.
Legal grounds
ANCOM’s draft decision follows the adoption of the Government Emergency Ordinance no. 46/2019 regarding the operation of the system for warning the population in case of emergency situations "RO-ALERT", which sets the legal framework on the roles and responsibilities of public institutions, as well as the obligations of the providers of mobile public electronic communications networks in the operation of the RO-ALERT System.
According to this normative act, ANCOM has the obligation to lay down the technical conditions regarding the use of the mobile public electronic communications networks and their connection with the RO-ALERT System, for the purpose of transmitting RO-ALERT messages.
