ANCOM: Another political actor complains about misleading use of the services offered by large online platforms

ANCOM received a complaint from a political actor about the misleading use of the services offered by some of the major online platforms during the electoral campaign. They denounce the inauthentic behavior observed regarding the posts on their official accounts on these platforms.

ANCOM asked the petitioner for additional information on the measures they had taken and gave a series of clarifications regarding their rights, as arising from the applicable obligations of online platforms provided in the Digital Services Act.

The providers of very large online platforms have established rules against this practice, through their terms and conditions. The possible misleading use of the services can be brought to the attention of, or reported to, the large online platforms by any person or entity through dedicated sections on the respective platform websites.

Furthermore, ANCOM contacted the online platforms in question for clarifications regarding their conduct in the reported situation and in relation to their obligations under the Digital Services Act.

Moreover, ANCOM also informed on this the European Commission team with responsibilities regarding the application of the Digital Services Act.

According to the Digital Services Act, the supervision of very large online platforms is under the shared competence of the European Commission and of the Digital Services Coordinators in the respective platforms’ country of establishment.
