ANCOM sanctions 200 operators for failure to send or for sending incomplete statistical data

“ANCOM applied 201 sanctions to the electronic communications providers that had not complied thoroughly with their obligation to send statistical data for 2015. These providers can fulfil their obligation within 30 days from the communication date, otherwise the communicated fines will be enforced. The fines amount to RON50 or RON300 per day of delay. The Authority does not aim at enforcing fines, as its objective is incentivizing providers to observe their legal obligations. Therefore, we urge the providers to correct the reporting errors as soon as possible. Accurately reporting statistical data is an extremely important instrument, based on which ANCOM makes regulatory decisions”,declared Cristin POPA, the Authority’s Executive Director.
 
Out of the 1,089 providers currently authorised with ANCOM, 201 were sanctioned for failure to send, sending incomplete data or sending without an electronic signature the statistical data for 2015.
 
135 provides were sanctioned for failure to comply with one of the reporting obligations for the year 2015 (they did not report any of the statistical data for the two semesters of 2015 and/or the data regarding the 2015 revenues and investments). Where a 30-day terms does not serve for remedying the failures, the providers will be sanctioned by an administrative fine amounting to RON300 per day of delay, counting from the expiry of the grace period granted by the Authority. If a provider does not comply with its legal obligations within another 30 day-term, its right to provide electronic communications services will be suspended.
 
42 providers received decisions on sanctioning by administrative fine, for failure to attach an electronic signature to the statistical data sent for 2015, whereas 24 providers were sanctioned for sending incomplete data. They have 30 days for thoroughly complying with their reporting obligations, otherwise incurring a penalty by an administrative fine of RON50 per day of delay until the reported data have been corrected.
The providers have the obligation to report statistical data on their activity and revenue from the provision of electronic communications services. Thus, until 10 August 2015, the providers had the obligation to send ANCOM the statistical data for the first half of 2015, and until 10 February 2016 – those corresponding to the second half of last year. The statistical data on the 2015 revenue and investments had to be submitted by 31 May 2016. For reporting statistical data to ANCOM, the providers of electronic communications have been made available an online application, which they can access by means of a username and a password. After completing the reporting, the providers are required to attach an electronic signature, for the authentication to be carried through.
