ANCOM launches consultation on the maximum tariffs for access to Netcity

We have launched a public consultation on the model for calculating the cost of access services offered to the providers of public electronic communications networks and on the maximum tariffs for access to the Netcity physical infrastructure, resulting from this model. In developing this model, we aimed at setting cost-oriented tariffs, in compliance with the criteria of transparency, objectivity and proportionality. We will also launch for public consultation a draft decision on the technical and economic conditions for the providers’ access to the Netcity infrastructure”, declared Sorin GRINDEANU, ANCOM’s President.
 
The cost calculation model
The tariffs were obtained taking into account the costs, based on a calculation model developed according to a set of transparent, objective, and justified criteria, using historical costs as a standard.
The Authority developed the cost model for the tariffs of access to ducts, based on the fully allocated cost method, with due regard to the need to apply principles and methodologies in line with the European practice and legislation, observing the principles of non-discrimination, objectivity, causality and proportionality.
 
The maximum proposed tariffs for access to Netcity infrastructure
The maximum tariffs applied by NETCITY TELECOM will not exceed:
- 75.97 euro/km/month for the Tubecity Transport (main pipe) rental service;
- 3.02 euro/piece for the Tubecity Racord (connection pipe) rental service, type A (maximum length: 20 meters);
- 10.87 euro/piece for Tubecity Racord (connection pipe) rental service, type B and special (length: over 20 meters);
- 8.03 euro for the FTTB connection (dark fibre) rental service;
These maximum tariffs do not include VAT.
 
Current tariffs for access to Netcity infrastructure
The tariffs currently applied by NETCITY TELECOM are as follows:
- from 85 to 120 euro/km/month for the Tubecity Transport rental service, depending on the usage degree;
- 10 euro/piece for the Tubecity Racord rental service, type A
- from 20 to 50 euro/piece for Tubecity Racord rental service, type B and special;
- from 10 to 15 euro for the FTTB connection rental service, depending on the usage degree.
 
State of play
ANCOM had issued the opinion on the technical and economic conditions for the providers’ access to electronic communications networks based on Law no. 154/2012, a document that was challenged in court, and was not implemented by the Netcity project developer. The current legislative framework in force, i.e. Law no. 159/2016, gives ANCOM the right to impose, through a decision that is binding for the Netcity project developer, the technical and economic conditions in which the providers’ access to this infrastructure is to be achieved.  
ANCOM has informed Netcity Telecom on the provisions of the current legal framework and has requested all the documents needed to set and impose technical and economic conditions for open access to the underground ducts deployed within the "Bucharest metropolitan fibre optic network for telecommunications - Netcity".
Next week, ANCOM will launch for public consultation a draft decision setting out the technical and economic conditions under which access to Netcity infrastructure will be achieved.

The draft model for calculating the cost of access services offered to the providers of public electronic communications networks for access to the physical infrastructure deployed within the "Bucharest metropolitan fibre optic network for telecommunications - Netcity” is available, in Romanian, here. The interested persons are invited to submit their comments and suggestions, by 31.10.2018, at the ANCOM headquarters (2 Delea Noua Street, Bucharest 3), directly to the ANCOM Registry Office or by means of the ANCOM regional divisions.
