ANCOM Issued the Opinion of Conformance for the Electronic Communications Providers’ Access to the Underground Infrastructure in the Old Town of Timișoara Municipality

The Romanian National Authority for Management and Regulation in Communications (ANCOM) issued and communicated to the Timișoara City Hall the Opinion of Conformance  on the technical and economic terms for the electronic communications providers’ access to the communications infrastructure deployed within the project ”Refurbishment of the public sites in the Old Town of Timișoara Municipality”. The Opinion of Conformance provides the implementation of certain measures meant to ensure the full conformity of the project with the legal provisions in force.
Thus, ANCOM requests the Timisoara City Hall to amend and complete the Regulation on the electronic communications networks’ access to the municipal infrastructure (underground ducts) by adding rules regarding the fair distribution of the capacity available in the underground ducts so as to ensure their efficient use and equitable access for all the requesters, to remove the restriction regarding the installation of one specified type of physical means, i.e. optical fibre, as well as to include the right of the providers who conclude contracts for access to the municipal ducts to share their own infrastructure/network with other electronic communications networks providers.
Moreover, following the analysis of the access conditions proposed by the Timisoara City Hall, the Authority deems necessary that the City Hall establish a reasonable term for the requesters to exercise their right of access with a view to installing their networks in the underground ducts.
The Timisoara City Hall developed and coordinated the project ”Refurbishment of the public sites in the Old Town of Timisoara Municipality”, aimed at refurbishing and modernizing the whole technical and urban utility infrastructure and public areas in the Cetate historic quarter of the Timișoara municipality and elaborated, and requested ANCOM to issue its Opinion on, the Regulation on the electronic communications networks’ access to the municipal infrastructure (underground ducts) built within the the project ”Refurbishment of the public sites in the Old Town of Timișoara Municipality”.
The project includes building - in the area of four markets and ten streets in the Timișoara Old Town - a network of underground ducts designed for the installation of electronic communications networks belonging to electronic communications providers, to local public administration, as well as to other institutions. By the end of 2020, all the providers of electronic communications networks will benefit from free access to the respective ducts.
The project is financed from the local budget of the Timisoara municipality, from the state budget and the European Regional Development Fund, while the duct infrastructure built within the project will remain in municipal property until at least 2020.
According to Law 154/2012 regarding the regime of the electronic communications networks infrastructure, the local authorities have the obligation to request ANCOM the Opinion of Conformance on the technical and economic conditions for access to the electronic communications networks built with the participation, support or financing of central or local public administration. Through the Opinion of Conformance tool, ANCOM aims at ensuring a coherent and equitable framework for access to infrastructure for all the providers who request it, under the legal provisions regarding non-discrimination, proportionality and objectivity.
