ANCOM Charges New Fine for Breaching the Rights of the Universal Postal Service Provider

ANCOM charged S.C. TOTAL POST MAIL SERVICES S.R.L., based in Ilfov, a fine amounting to RON 20,000 for breaching the right reserved to the universal service provider in the field of postal services. This company provided postal services dealing with correspondence items up to 50 grams at a tariff lower than RON 2/item.
The reserved right was granted to CNPR on 26 April 2009, following a procedure for the designation of the universal service provider organised by ANCOM, the participants of which were CNPR and the company Posta Atlassib Curier Rapid. With a view to ensuring the right of the users of access to the universal service, CNPR also benefits, until the end of this year, from the exclusive right to provide postal services dealing with items of correspondence, irrespective whether delivery is accelerated or not, weighing up to 50 g and at a tariff lower than RON 2, consisting in clearance, sorting, transport and delivery of domestic items of correspondence and the distribution of correspondence items sent from outside Romania to an address located on its territory. The quality as a universal service provider involves not only rights, but also obligations. Among these obligations we count at least one clearance from each access point and at least one delivery to the home of each natural person and to the headquarters of each legal person, on each and every working day, not less than 5 days a week, at the same tariffs, in every locality on the Romanian territory including in remote or sparsely populated areas, featuring low quantities of correspondence.
”During 2012, we found that many providers of postal services have not observed the right reserved to the National Company Romanian Post (CNPR). For breach of this right, ANCOM charged 10 contravention fines amounting to RON 281,000 and applied two sanctions of temporary suspension of the right to provide postal services. This was the most frequent breach on the market of postal services, which ANCOM sanctioned by fine in 2012, declared Cristin Popa, Director of the Executive Division Monitoring and Control of ANCOM.
