ANCOM communicated to the Mayoralty of Târgu Mureș its decision approving the technical and economic conditions for the access of the providers of public electronic communications networks to the physical infrastructure built by the municipality. The ANCOM Decision no. 554/2020 covers the tariffs and the other access conditions included in the access regulation, as well as in the model of the access agreement and the model of the request for access to the underground ducts of Târgu Mureș. 

The technical and economic conditions for the access to the infrastructure of the municipality of Târgu Mureș

The underground ducts intended for the installation of public electronic communications networks in Târgu Mureș are built from the municipality’s own funds.

The Mayoralty of Târgu Mureș ensures the same conditions of access and use of the underground infrastructure to all the providers of public electronic communications networks. The access is granted upon the providers’ request, following an analysis and planning of the occupancy of the available space, with the main purpose of ensuring the optimum and judicious use of the ducts space.

Where the conditions for the granting of access to the underground electronic communications infrastructure are fulfilled, the Mayoralty of Târgu Mureș concludes with the providers in question access agreements which establish the conditions for exercising this right. The installation of the public electronic communications networks will take place under the supervision of the representatives of the local public authorities.

Tariffs

The tariffs proposed by the Mayoralty of Târgu Mureș with a view to encourage efficient investments in the infrastructure required for the provision of broadband internet access services are as follows:

ü  0.36 lei/linear meter/year for the service of rental of the space corresponding to a cable with a 10 mm diameter, located in the municipality’s ducts;

ü  for the cables with exterior diameters other than 10 mm, located in the municipality’s ducts, the tariff mentioned above will be amended proportionally to their diameter.

The tariffs depend on the actual length of the cables and/or sub-ducts subject to access, do not include VAT and will be annually indexed with the inflation rate.

Obligations of the Mayoralty of Târgu Mureș

The Mayoralty of Târgu Mureș has the obligation to publish on its website all the essential information on the electronic communications underground physical infrastructure (location, availability of space within the ducts) and to update this information whenever necessary.

Where it rejects an access request, within 15 days, the Mayoralty of Târgu Mureș has the obligation to communicate to the requester in question the objective reasons which grounded the rejection decision.

 

Another obligation of the local authority refers to ensuring the uninterrupted provision of the services of access to the physical infrastructure, the interruption of service provision being accepted only in well justified cases.
