ANCOM Applied the Third Fine to Direct Post and Suspended Temporarily the Right of This Company to Provide Postal Services

ANCOM applied a RON 40,000 fine to S.C. DIRECT POST SERVICES S.R.L.for the provision of correspondence items weighing up to 50 g at a tariff lower than RON 2 per item. The company thus breached the reserved right of the universal service provider in the postal field, namely the Romanian Post National Company (CNPR).
This is the third contravention fine ANCOM has enforced on this postal provider for the breach of the same legal provisions, after having sanctioned it with RON 5,000 in January 2012 and with RON 30,000 in June 2012, respectively.
Besides these contravention sanctions, ANCOM also decided to suspend until the end of this year the right of Direct Post to provide all the categories of postal services which it was authorised to provide.
CNPR gained the reserved right on 26 April 2009, following a procedure of designation of the universal service provider held by ANCOM in which CNPR and Posta Atlassib Curier Rapid submitted applications. In view of ensuring the users’ right to access the universal service, CNPR benefits among others from the exclusive right to provide postal services subject to correspondence items weighing less than 50 g and costing less than RON 2, regardless of whether their delivery is accelerated or not, which consist of the clearance, sorting, transport and delivery of domestic correspondence items and the distribution of correspondence items sent from outside Romania to an address located on its territory.
The exclusive right of CNPR to provide postal services subject to items of correspondence weighing less than 50 g and costing less than RON 2, regardless of whether their delivery is accelerated or not, expires as of 31 December 2012. Afterward, any postal provider will have the right to provide this type of service. For this purpose, the Authority submitted to public consultation two draft decisions that create the premises for the full liberalisation of the postal market.
Furthermore, ANCOM applied a RON 5,000 fine to PETROVAN FLOREA I.F. and a RON 6,000 fine to S.C. ADAT-ILCOM S.R.L. which also breached the reserved right of CNPR.  
In total, during this year, ANCOM applied 9 contravention fines amounting to RON 261,000, for the breach of the reserved right of CNPR.
