ANCOM Performed Almost 700 Control Actions in the North-East of Romania in the First Half of This Year

In the first half of 2013, the Iasi Regional Division of the Romanian Authority for Management and Regulation in Communications (ANCOM) performed a number of 741control actions in the 8 counties in north-eastern Romania it monitors. Following these control actions, 54 warnings and one fine were applied, amounting to RON 5,000.
400 inspections focused on the holders of licences for the use of radioelectric frequencies, 243 of which were performed on the providers of radiocommunications services and 157 on the radio and television providers. Following these control actions, 21 warnings as well as one fine amounting to RON 5,000 were applied. The fine was applied to the company E-GROSS S.R.L. of Iasi, for using radioelectric spectrum frequencies without an emission licence.
Almost one third of the total number of control actions, respectively 216, envisaged the electronic communications providers: 101 inspections were performed on the internet providers and 115 on the providers of audio-visual programme retransmission services. With a view to remedying the assessed deficiencies, Iasi Regional Division of ANCOM issued 27 warnings.
53of the inspections conducted in the first half of 2013 envisaged the providers of postal services and resulted in the enforcement of 6 warnings. 4 of these inspections were conducted at the National Company Romanian Post (CNPR), while the rest, i.e. 49 inspections, at the others providers of postal services.
72 control actions focused on the producers, importers and distributors of radio equipment and of terminal telecommunications equipment, with no infringements assessed.
The most frequent infringements assessed during the 741 control actions in the north-eastern area of the country were the breach of the technical parameters under the licences and authorisations, the breach of the decisions regarding the general authorisation regime for the provision of electronic communications networks and services, failure to transmit the annual financial statements in due time, and to draw up, keep and annually update the technical file of the network.
”Compared to last year’s similar period, we witness a decrease of the sanctions enforced by the Authority, which reveals that our inspectors’ control actions reach their target, preventing and discouraging the possible breaches of the providers of electronic communications and of postal services. ANCOM’s monitoring, surveillance and control activity is aimed at ensuring the enforcement and observance of the legal provisions in order to promote fair competition and to protect the users’ interests”, declared Cristin POPA, Director of ANCOM’s Executive Division Monitoring and Control.
128 of the control actions performed by ANCOM’s Iasi Regional Division in the first half of 2013 were conducted in the county of Neamt, 117 in the county of Iasi, 91 in the county of Galati, 83 in the county of Vrancea, 76 in the county of Bacau, 70 in the county of Suceava, 68 in the county of Vaslui, 62 in the county of Botosani and 46 in the county of Braila.
During the first half of 2013, 1,810 radio spectrum monitoring actions were conducted, following which 8 situations of unauthorised radio emissions were detected, as well as situations of breach of the conditions provided in the emission licences, in the technical operation authorisations, in the licences for the use of the radio spectrum, or in the authorisations for spectrum resource assignment. In all these situations the necessary steps were immediately taken for restoring the legal status.
Moreover, ANCOM assessed the 2G/3G coverage of 13 towns and more than 2,300 km of roads.
