ANCOM Performed More than 2,700 Inspections and Almost 6,000 Monitoring Actions in the First Half of This Year

In the first half of 2013, the Romanian Authority for Management and Regulation in Communications (ANCOM) performed a number of 2,767control actions following which 104 warnings and 18 fines were applied, amounting to RON 94,800.
1,395 inspections, representing more than half of the total number, focused on the holders of licences for the use of radioelectric frequencies, 918 of which were performed on the providers of radiocommunications services and 477 on the radio and television providers. Following these control actions, 25 notifications on the intention of enforcing a sanction were issued, and 50 warnings as well as 14 fines amounting to RON 52,800 were applied. The most frequent infringements assessed during the control actions were the breach of the provisions under the licences and authorisations, as well as the inadequate operation of radiocommunications stations by persons who did not hold a radiotelephone operator's certificate.
Approximately one third of the total number of control actions, respectively 760, envisaged the electronic communications providers and were focused on observance of the obligations provided in the general authorisation: 431 inspections were performed on the internet providers, 6 on the telephony providers and 323 on the providers of audio-visual programme retransmission services. The inspections revealed that some operators do not observe the obligation to introduce, in the contracts concluded with the end-users, the minimum clauses provided by the law and breach certain technical EMC conditions imposed to the electronic communications networks by the general authorisation regime. With a view to remedying the assessed deficiencies, ANCOM issued 88 notifications regarding the intention of enforcing a sanction, followed by 43 warnings and 4 fines amounting to RON 42,000. One RON 25,000 fine was applied to a telephony provider for the improper use of the mobile telephony numbering resources and 3 fines were applied to providers of audio-visual programme retransmission services, for the unauthorised provision of audiovisual media services without a standard certificate or for modified technical parameters, compared to the one allowed by the general authorisation.
180 of the inspections conducted in the first half of 2013 envisaged the providers of postal services and resulted in the enforcement of 7 warnings. The most frequent deficiencies regarded the breach of the obligations to mark all the items introduced in the postal network with the provider’s name or trade mark, as well as the infringement of some of the obligations provided in the general authorisation for the provision of postal services, respectively failure to have the necessary measuring instruments, at each manned access point.
432 control actions focused on the producers, importers and distributors of radio equipment and of terminal telecommunications equipment. Following these actions, 4 warnings were enforced for breach of the legal provisions in the field.
During the first half of 2013, 5,806 radio spectrum monitoring actions were conducted, following which 208 situations of unauthorised radio emissions were detected, as well as situations of breach of the conditions provided in the emission licences, in the technical operation authorisations, in the licences for the use of the radio spectrum, or in the authorisations for spectrum resource assignment. In all these situations the necessary steps were taken for restoring the legal status.
Moreover, ANCOM assessed the 2G/3G coverage of 63 towns and more than 11,570 km of roads.
