ANCOM Performed Almost 1,000 Control Actions in the South-East of Romania in the First Half of This Year

In the first half of 2013, the Bucharest Regional Division of the Romanian Authority for Management and Regulation in Communications (ANCOM) performed a number of 1,046control actions in the 15 counties in south-eastern Romania it monitors. Following these control actions, 12 warnings and 4 fines were applied, amounting to RON 40,000.
455 inspections focused on the holders of licences for the use of radioelectric frequencies, 350 of which were performed on the providers of radiocommunications services and 150 on the radio and television providers. Following these control actions, 3 notifications on the intention of applying a sanction were issued and 7 warnings as well as 3 fines amounting to RON 15,000 were applied. The fines were applied to the companies: Studio TVC S.R.L. (Alpha TV Arges), Radiocity FM Bucuresti S.R.L. (City FM Bucuresti) and Atelierele Culturale S.R.L. (Activ TV Bucuresti).
Almost one third of the total number of control actions, respectively 398, envisaged the electronic communications providers: 274 inspections were performed on the internet providers, 6 on the telephony providers, and 118 on the providers of audio-visual programme retransmission services. With a view to remedying the assessed deficiencies, the Bucharest Regional Division of ANCOM applied 5 warnings and a fine amounting to RON 25,000 (to the Company Enigma-System Mobile Virtual Network Operator).
55of the inspections conducted in the first half of 2013 envisaged the providers of postal services and 138 focused on the producers, importers and distributors of radio equipment and of terminal telecommunications equipment, with no infringements assessed.
The most frequent infringements assessed during the 1,046 control actions in the south-eastern area of the country were the breach of the operators’ obligation to publish, on their own website, the values of the parameters corresponding to the administrative quality indicators for the provision of the internet access service according to the reporting periods established by ANCOM or the unauthorised modification of the technical and operational parameters provided in the frequency assignment authorisation, for the holders of an transmission emission authorisation.
We witnessed the revival of an alarming phenomenon in the south-eastern area of Romania: the unlicenced emission of pirate radio stations. These emissions may cause harmful interferences, both for the authorised radiobroadcasters that use the same band or adjacent bands, and for other radiocommunications services – some of national importance – i.e. radionavigation services. In the first half of 2013, the Authority’s inspectors detected 10 pirate radio stations that broadcasted without a licence in the counties of Arges, Dambovita, Giurgiu and Prahova”, declared Cristin POPA, Director of ANCOM’s Executive Division Monitoring and Control.
77 of the control actions performed by ANCOM’s Iasi Regional Division in the first half of 2013 were conducted in the county of Arges, 87 in the county of Brasov, 64 in the county of Buzau, 51 in the county of Calarasi, 90 in the county of Constanta, 52 in the county of Dambovita, 47 in the county of Giurgiu, 42 in the county of Ialomita, 43 n the county of Olt, 77 in the county of Prahova, 35 in the county of Teleorman, 79 in the county of Tulcea and 40 in Bucharest and the county of Ilfov.
During the first half of 2013, 631 radio spectrum monitoring actions were conducted, following which 38 situations of unauthorised radio emissions were detected, as well as situations of breach of the conditions provided in the emission licences, in the technical operation authorisations, in the licences for the use of the radio spectrum, or in the authorisations for spectrum resource assignment. In all these situations the necessary steps were immediately taken for restoring the legal status. Moreover, ANCOM assessed the 2G/3G coverage of 10 towns and more than 1,148 km of roads.
