ANCOM Performed Almost 600 Control Actions in the North-West of Romania in the First Half of This Year

In the first half of 2013, the Cluj Regional Division of the Romanian Authority for Management and Regulation in Communications (ANCOM) performed a number of 598control actions in the 11 counties in north-western Romania it monitors. Following these control actions, 24 warnings and 7 fines were applied, amounting to RON 19,800.
313 inspections focused on the holders of licences for the use of radioelectric frequencies, 188 of which were performed on the providers of radiocommunications services and 125 on the radio and television providers. Following these control actions, 12 warnings as well as 5 fines amounting to RON 7,800 were applied (to the company Gami Ro Net S.R.L. of Cluj Napoca, as well as to 4 natural persons).
The most frequent infringements assessed were the operation of radiocommunications networks by persons who did not hold a radiotelephone operator's certificate, as well as the modification of the technical and operational parameters provided in the frequency assignment authorisations, without having submitted corresponding modification requests to ANCOM.
84 control actionsenvisaged the electronic communications providers: 47 inspections were performed on the internet providers and 37 on the providers of audio-visual programme retransmission services. With a view to remedying the assessed deficiencies, ANCOM issued 6 notifications regarding the intention of enforcing a sanction, followed by 8 warnings and 2 fines amounting to RON 12,000. The fines were applied to the providers of audio-visual programme retransmission services Action News S.R.L. and Bloomstation S.R.L of Cluj Napoca, for the provision of audiovisual media services without a standard certificate issued by ANCOM.
41of the inspections conducted in the first half of 2013 envisaged the providers of postal services and resulted in the enforcement of one warning.
160 control actions focused on the producers, importers and distributors of radio equipment and of terminal telecommunications equipment. Following these actions, 3 warnings were enforced for breach of the legal provisions in the field.These sanctions were enfored for placing unhomologated GSM repeaters on the market.
”An alarming phenomenon detected in the north-west of Romania, this year, is selling and holding equipment that causes harmful interferences to GSM stations. The sale and use of such equipment are prohibited in Romania, as it jams GSM signal and hinders mobile telephony services”, declared Cristin POPA, Director of ANCOM’s Executive Division Monitoring and Control.
55 of the control actions performed by ANCOM’s Cluj Regional Division in the first half of 2013 were conducted in the county of Alba, 74 in the county of Bihor, 85 in the county of Bistrita-Nasaud, 48 in the county of Cluj, 23 in the county of Covasna, 43 in the county of Harghita, 65 in the county of Maramures, 62 in the county of Mures, 39 in the county of Salaj, 38 in the county of Satu-Mare and 66 in the county of Sibiu.
During the first half of 2013, 912 radio spectrum monitoring actions were conducted, following which 13 situations of unauthorised radio emissions were detected, as well as situations of breach of the conditions provided in the emission licences, in the technical operation authorisations, in the licences for the use of the radio spectrum, or in the authorisations for spectrum resource assignment. In all these situations the necessary steps were immediately taken for restoring the legal status.
Moreover, ANCOM assessed the 2G/3G coverage of 28 towns and more than 4,973 km of roads.
