ANCOM Performed 382 Inspections and 2,453 Spectrum Monitoring Actions in the Western Area of Romania in the First Half of This Year

In the first half of 2013, the Timis Regional Division of the Romanian Authority for Management and Regulation in Communications (ANCOM) performed a number of 382inspections in the 7 counties in north-eastern Romania it monitors, applying 14 warnings and 6 fines, amounting to RON 30,000.
227 inspections focused on the holders of licences for the use of radioelectric frequencies, 137 of which were performed on the providers of radiocommunications services and 90 on the radio and television providers. Following these inspections, 10 warnings as well as 5 fines amounting to RON 25,000 were applied. The fines were applied to the companies Slag Reciclynd Entreprise S.R.L. of Caras-Severin, Deea Taxi S.R.L., Auto Trans Meda and 7 S.R.L., Sbs Broadcasting S.R.L. of Hunedoara and Interstancos S.R.L. of Mehedinti, for breach of the technical parameters provided in the licences for the use of radio frequencies, respectively in the broadcasting licences, for the use of the licence-free radioeletric frequencies in breach of the technical and operational conditions required for preventing harmful interferences.
62 inspections envisaged the electronic communications providers: 9 inspections were performed on the internet providers and 53 on the providers of audio-visual programme retransmission services. These inspections resulted in the enforcement of 3 warnings and one fine amounting to RON 5,000, on S.C. Favorit S.R.L., for breach of the technical and electromagnetic compatibility conditions. The assessed infringements regarded, in general, the use of the electronic communications networks for the retransmission of audio-visual programme services and for data transmission and internet access services in breach of the technical and electromagnetic compatibility conditions provided in the general authorisation regime and failure to introduce the minimum clauses provided by the law in the contracts concluded with the end-users.
31 of the inspections conducted in the first half of 2013 envisaged the providers of postal services. The ANCOM inspectors assessed that the postal service providers observed the regulations and the legal provisions.
62 control actions focused on the producers, importers and distributors of radio equipment and of terminal telecommunications equipment, following which one warning was issued, for lack of the CE conformity marking.

64 of the control actions performed by ANCOM’s Timis Regional Division in the first half of 2013 were conducted in the county of Arad, 28 in the county of Caras-Severin, 60 in the county of Dolj, 65 in the county of Gorj, 74 in the county of Hunedoara, 44 in the county of Mehedinti and 47 in the county of Timis.
During the first half of 2013, 2,453 radio spectrum monitoring actions were conducted, following which 157 situations of unauthorised radio emissions were detected, as well as situations of breach of the conditions provided in the broadcasting licences, in the technical operation authorisations, in the licences for the use of the radio spectrum, or in the authorisations for spectrum resource assignment. In all these situations the necessary steps were immediately taken for restoring the legal status. Moreover, ANCOM assessed the 2G/3G coverage of 12 towns and more than 3,148 km of roads.
