ANCOM approved the conditions on access to underground ducts for the installation of public electronic communications networks in Sibiu

ANCOM communicated to the Mayoralty of Sibiu its decision approving the technical and economic conditions for the access of the providers of electronic communications networks to the physical infrastructure built by the Mayoralty of Sibiu (PMS). The ANCOM Decision no.862/2019 covers the tariffs and the access rules, and contains as well a model of the access agreement and a model of the request for access to the underground ducts of Sibiu.
The technical and economic conditions for the access to the PMS infrastructure
The PMS builds the underground ducts intended for the installation of public electronic communications networks from both its own funds and from European funds, while the technical and economic conditions for the access to this infrastructure are submitted to the ANCOM approval.
Thus, according to the Access Rules, the underground physical infrastructure built will remain under the municipality’s property, whereas the providers of public electronic communications networks will access it under the conditions set by the local authority and approved by ANCOM. The PMS will ensure all the providers the same conditions of access and use of the underground infrastructure. The access will be granted upon the providers’ request, following an analysis and planning of the occupancy of the available space, with the main purpose of ensuring the optimum and judicious use of the ducts space.
Where the conditions for the granting of access to the underground electronic communications infrastructure are fulfilled, the PMS concludes with the providers in question access agreements which establish the conditions for exercising this right. These providers will subsequently install their public electronic communications networks under the supervision of the representatives of the local public authorities.
Tariffs
The tariffs proposed by the PMS and approved by ANCOM are as follows:
The tariffs depend on the actual length of the cables and/or sub-ducts subject to access, do not include VAT and will be annually indexed with the inflation rate.
Obligations of the PMS
The PMS has the obligation to publish on its website all the essential information on the electronic communications underground physical infrastructure (location, availability of space within the ducts) and to update this information whenever necessary.
Where it rejects an access request, within 15 days, the PMS has the obligation to communicate to the requester in question the objective reasons which grounded the rejection decision.
Another obligation of the local authority refers to ensuring the uninterrupted provision of the services of access to the physical infrastructure, the interruption of service provision being accepted only in well justified cases.
