Amendments to the Secondary Legislation on the Usage of Numbering and of Technical Resources

The Romanian Authority for Management and Regulation in Communications (ANCOM) completed, during the Consultative Council, two decisions regarding the numbering and the technical resources: a decision on the amendment and completion of regulation in the field of the numbering and of the technical resources used for the provision of telephone/communications services and a decision on the use of internal national short numbers and of SMS/MMS short codes.

The amendments and completions concern the National Numbering Plan (PNN), the procedure for requesting and issuing a licence for the use of numbering resources, respectively the procedure for the allotment and usage of technical numbering resources, as well as the conditions for the usage of 19vx(y) or 118(xyz) national short numbers.
Regarding the NNP, the regime of internal national short numbers for the provision of internal network services (e.g. customer relations) and for value-added services, of one of the formats: 12vx(y), 13vx(y), 14vx(y), 15vx(y), 17vx(y), 18vx(y), 83vx(y), 84vx(y), 88vx, 96vx(y) – 99vx(y), was regulated. Moreover, following the development of electronic communications services provided at mobile locations, ANCOM is opening a new numbering domain for mobile communications, so that the numbers starting by 06 could be allocated to providers of electronic communications services provided at mobile locations.
Once with the entry into force of the new decision agreed with the industry, the providers of public electronic communications networks will be able to receive and use geographic numbers, location-independent numbers or non-geographic numbers for services provided at mobile locations. A network provider could be interested in these numbers in order to assign them to the providers of publicly available electronic communications services they host, including to MVNOs. Thus, the decision, in accordance with the new legislative framework in the field of electronic communications, will open the possibility of direct transfer of part of the numbering resources allocated to a licence holder, towards a provider of electronic communications services, without having to carry through the procedure of issuing and requesting a new licence for the use of numbering resources from ANCOM. Furthermore, based on its experience, the Authority included in the decision a series of measures meant to simplify the procedure of granting a licence for the use of numbering resources and extended the term for activating the allocated numbering resources from 6 to 12 months, in order to ensure sufficient time for negotiating and concluding interconnection agreements.
The Authority also extended the types of services to be provided by means of 19vx or 19vxy numbers, by including a new category of services – services of general interest, while differentiating the tariff to be charged by the providers, depending on the sub-domains used.
ANCOM regulates for the first time the use of the internal national short numbers and of the SMS/MMS short codes, establishing by decision a series of numbering resources used for the provision of value-added services and of network specific services. The services accessible exclusively by SMS/MMS shall be provided by means of special codes, of a format to be established by the providers of public electronic communications networks together with the ANCOM representatives by means of a Code of Conduct, within seven months from the entry into force of this decision.
This decision is aimed at ensuring the legal framework for better informing the end-users, especially as regards the tariffs and the harmonised use of the internal national short numbers and of the SMS/MMS short codes for the provision of value-added services upon expiry of a three-year transition term from the entry into force of this decision.
The decisions on numbering resources will be sent to the Romanian Official Journal, for publication.
