ANRC Suggests Simpler Rules for the Authorisation of Postal Services Providers

ANRC submits to public consultation the draft decision on the general authorisation regime for the provision of postal services. This decision envisages two main objectives, namely to simplify the rules imposed on the postal services providers during the authorisation process and to establish a new classification for postal services.

 

The decision sets out the conditions for opening the postal services market also to natural persons. The latter may become providers of postal services and may benefit from the same rights as the companies already operating in this field.

 

Following the adoption of this decision, when entering the postal services market, a new provider will only have to fill in the notification file and send it to ANRC, thus obtaining the right to provide services starting on the date mentioned in the notification form or, if this date is not mentioned, on the date the request is registered with ANRC.

 

Another change envisaged by ANRC is to remove the individual licences in order to simplify the authorisation regime, so that all the postal services (within the scope of universal service or not) may be provided based upon a unique authorisation regime. Moreover, pursuant to its permanent dialogue with the industry, ANRC decided to include the direct mail service in the scope of universal service, thus allowing a better regulation of the respective market, currently undergoing significant developments. The decision also clearly states all rights and obligations of the postal services providers in their relations with the users and with ANRC.

 

The main normative act regulating the field of postal services - the Government Ordinance no.31/2002 on postal services – has been amended and modified after the entering into force, as of November 2, 2006, of the Government Emergency Ordinance no.70/2006 on amending and completing certain normative acts in the fields of electronic communications and of postal services. Subsequently, as of December 31, 2006 and as of the date when Romania becomes a member of the European Union, the decision will be further amended and completed by the same emergency ordinance.

 

The daft decision on the general authorisation regime for the provision of postal services is available for consultation on the ANRC website. All interested persons are invited to send their comments and suggestions by December 15, 2006, by mail, to the ANRC headquarters (14 Libertatii Blvd., 5th District, Bucharest) or directly to the ANRC registration office or to the closest territorial office of ANRC.
