ANCOM

The European Commission has published the Code of practice on Transparency of AI-Generated Content with the aim of supporting compliance with transparency obligations related to the marking and labelling of AI-Generated content. These obligations are set forth in Article 50 of the AI Act and will take effect on August 2, 2026.

Transparency obligations

Providers of artificial intelligence systems, including generative AI systems, generating synthetic audio, image, video of text content, are required to integrate a machine-readable marking technique.

Labelling obligations apply to deployers of AI system that generates or manipulates deepfake audio, video or image content, or published texts for the purpose of informing the public about matters of public interest. The European Union has developed a set of icons that can be used to label AI-generated content; these are available free of charge and are included in the Code of Best Practices.

The European Commission invites public and private sector entities that develop or use artificial intelligence systems – such as software providers, telecom operators, media agencies and publications, digital platforms, advertising agency, and public institutions – to become signatories to the Code, as an expression of their commitment to transparency and the responsible use of artificial intelligence systems.

Signatories to the Code will thus benefit from greater predictability regarding the steps they must take to demonstrate compliance with transparency obligations.

Information session on the signing of the Code of Practice

To support potential signatories, the European Commission’s AI Office is organising an online info session to present the Code and the signature process. The session will take place on June 22, 2026. The registration deadline for participation is June 18, 2026.

ANCOM supports initiatives that contribute to greater transparency in the digital environment, enable users to make informed decisions, help combat misinformation, and promote accountability and trust. The Romanian Government, through a Memorandum, has proposed that ANCOM serve as the national supervisory authority and single national point of contact for the implementation of Regulation (EU) 2024/1689 on artificial intelligence (AI Act).
