The designation of the operator having significant power on the market of access to the local loop

Two new decisions projects have been submitted to public consultation on the website of the National Regulatory Authority for Communications (ANRC) - www.anrc.ro : Part III of the Regulations on the Identification of Relevant Markets Within the Electronic Communications Sector and The decision on the designation of the SNTc Romtelecom SA as operator having significant power on the market of unconditioned access to the twisted metallic pairs local loop for the purpose of providing broadband data services and voice services.

The third part of the Regulations on the designation of the relevant markets in the electronic communications sector refers to wholesale markets and establishes the following as relevant: the market for provision of unconditioned access to the twisted metallic pairs local loop for the purpose of providing broadband data services and voice services (at least 128 Kb/s), the market for provision of leased lines at local level, and market for access to the associated facilities of the electronic communications networks. The associated facilities include, among others, high and low voltage transmission line poles, ducts, trenches, buildings, towers, subway tunnels etc.

On grounds of this Regulation, through this project of decision, ANRC designates S.N.Tc "Romtelecom" - S.A. as operator having significant power on the market of unconditioned access to the twisted metallic pairs local loop for the purpose of providing broadband data services and voice services.

After adopting this decision, ANRC will be able to impose to S.N.Tc "Romtelecom" - S.A. one or more of the obligations under art. 9-14 of Government Ordinance no. 34/2002 on access to, and interconnection of, public electronic communications networks, approved with amendments and additions by Law no. 527/2002. Such obligations may refer to transparency, nondiscrimination, separate accounting, or tariffs that reflect real costs.

Both projects will remain at public disposal, for consultation purposes, until December 25, 2002, and are available on ANRC Internet page
