Decisions on frequency spectrum management, under public consultation

ANCOM has launched for public consultation three draft decisions regarding the procedure for awarding frequency usage rights, licence-exempt frequencies or frequency bands, and setting the spectrum usage tariff.

Procedure for awarding frequency usage rights

The Draft decision for amending and completing Decision no. 353/2015 on the procedure for granting frequency usage rights proposes to amend some provisions and introduce new ones to ensure radio protection upon request, in cases of frequency spectrum usage exclusively for reception, in certain situations exhaustively specified therein, i.e. meteorological aids service, meteorological-satellite service, science satellite services - active or passive - (Earth exploration-satellite service, space research or space operations) or radio astronomy service.

The proposed decision removes the obligation to obtain an individual authorization in the case of certain types of terminal radio equipment operating in transmitting or transmitting/receiving mode, and exclusively under the control of an electronic communications network for which a frequency usage license has been issued. Initially, terminals operating in global mobile/fixed satellite communications networks are considered, thus ensuring the possibility of implementing the relevant CEPT/ECC decisions and encouraging the development and use of global mobile/fixed satellite communications networks in Romania.

At the same time, the draft decision clarifies the administrative procedure for requesting and granting licenses for temporary experimental or occasional transmissions and the procedure for extending the validity of frequency usage licences granted by direct awarding.

Licence-exempt radio frequencies or radio frequency bands

The Draft Decision on amending and completing the Decision of the President of the National Authority for Management and Regulation in Communications no. 311/2016 regarding the licence-exempt radio frequencies or radio frequency bands introduces certain definitions and clarifications on the operating conditions of licence-exempt radio equipment.

Given the growing number of global mobile/fixed communications networks that have started to provide services via artificial satellites of the Earth, the project proposes amendments which, in conjunction with those included in the draft decision on amending and completing ANCOM President’s Decision no. 353/2015, encourages the development and use of this type of networks on the Romanian territory, so that they become a commercially and operationally viable alternative to existing terrestrial networks.

Setting the spectrum usage tariff

The Draft Decision on completing the Decision of the President of the National Authority for Management and Regulation in Communications no. 551/2012 on setting the spectrum usage tariff proposes the spectrum usage tariff for the provision - in Romania - of electronic communications services through global mobile/fixed communications networks using artificial satellites of the Earth. These types of networks use geostationary or non-geostationary satellites and frequency bands above 10 GHz.

Moreover, the draft aims to clarify the application of the tariff set for transmitting frequencies assigned for portable radio relay equipment (installed on wireless cameras), intended for the temporary and occasional transmissions of sound and/or television broadcasting. This type of radio applications has seen significant diversification since the authority set the spectrum usage tariff – the temporary and occasional transmissions to take place in June this year, at the EURO2020 Football Championship organized by UEFA in several locations including Romania, being one example.
