ANCOM Adopted a Series of Measures in Its Latest Consultative Council Meeting

The Romanian National Authority for Management and Regulation in Communications (ANCOM) agreed with the Romanian electronic communications and postal industry the Authority’s 2014 Action Plan, the Position Paper on the radio spectrum use at a national level in the 24.5-25.5 GHz / 25.5-26.5 GHz frequency bands and the decision on the adoption of the Local loop and sub-loop frequency spectrum management plan. Furthermore, it was established the form under which the draft measures on determining the prices for certain wholesale electronic communications services, based on certain cost calculation models, are to be transmitted in view of European consultation.
According to the Action Plan adopted in this meeting, in view of implementing the infrastructure law, ANCOM will start a project for creating a national inventory of the public electronic communications networks and of the associated infrastructure elements, to be continued throughout several years, and will continue the infrastructure law communication campaign.
For the effective management of the radio spectrum, ANCOM will support the digital switchover process by organising the selection procedure for granting five DTV multiplexes. Moreover, the Authority will elaborate the documentation for organising the selection procedure in view of awarding the rights for the use of the radio-electric spectrum in the 3400 - 3800 MHz band, will adopt the Strategy for awarding the rights of use in the 410 and 450 MHz bands and will elaborate the Strategy for awarding the rights of use of the radio-electric spectrum that was not awarded in the 2012 auction, in the 800 MHz and 2600 MHz bands.
With a view to promoting competition in the electronic communications field, ANCOM will review the relevant markets for the services of unbundled access to the local loop and of leased lines-terminating segments, will identify the providers with significant market power – as the case may be – as well as the corresponding remedies. In order to increase the users’ awareness, the Authority envisages amending the ANC President’s Decision no.77/2009. Furthermore, the Authority will conduct an ample control campaign on the providers of publicly available electronic communications services, in order to check the inclusion of the minimum clauses in the contracts concluded with the end-users.
In the postal sector, ANCOM will determine in 2014, if applicable, the net cost and will establish the financing mechanisms for the universal postal service. As well, the Authority will approve the Framework-agreement and the rules of providing the postal services within the scope of universal service.
In the same Consultative Council meeting, the principles and conditions on the use of the 26 GHz band were presented. Thus, starting 2014, the Authority will award usage rights in this band only for radio-relay lines, based on justified requests.

The Authority also finalised the consultation with the industry on the review of the Local loop and sub-loop frequency spectrum management plan of Romtelecom’s access network by inserting in the Plan the VDSL2 transmission technology and removing the ADSL.FDD over ISDN and ADSL2+ over ISDN technologies. Within 10 days from the entry into force of this decision, Romtelecom will have the obligation to revise its reference offer for the unbundled access to the local loop.
