Approximately 3.700 control actions conducted in 2021

”In 2021, ANCOM conducted almost 3,700 control actions, and sanctioned breaches with fines amounting over RON 3.5 million. Last year, we also carried out another measurement campaign for verifying coverage with mobile voice signal in areas where new base stations were notified to have been installed for increasing the level of coverage”, declared Cristin Popa, Director of ANCOM’s Monitoring and Control Executive Division.

Following the 3,682 control actions, ANCOM issued 230 notifications and applied 776 warnings and 329 contravention fines, amounting RON 3,585,500. This amount is revenue to the state budget.

Electronic communications market

In 2021, ANCOM conducted 2,046 control actions in the electronic communications market, issuing 230 notifications and applying 320 warnings and 142 contravention fines amounting RON 2,750,500.

ANCOM applied 84 contravention fines totalling RON 1,736,000 to mobile telephony providers for failure to fulfil the coverage obligations provided in their licences, for breach of obligations regarding the conclusion of contracts with the end-users and the carrying out of the telephone number porting process, and for other infringements.

Furthermore, in 2021, ANCOM carried out a new campaign for measuring the national coverage with voice services of areas inhabited by at least 98% of the country’s population, performing measurements only in areas where the operators had declared significant coverage improvements.

ANCOM applied 5 contravention fines amounting RON 50,000 to internet service providers, the highest of which - RON 30,000 – being applied for providing electronic communications networks and services without a valid authorisation in place.

Moreover, ANCOM applied 24 contravention fines totalling RON 732,000 to radio and TV broadcasting (RTV) providers, mainly for failure to comply with the technical data, parameters or conditions provided in the technical authorisations.

CATV network providers were sanctioned by 24 contravention fines amounting RON 202,500 for failure to observe the conditions provided in the General Authorisation, while the radiocommunications operators were sanctioned by 5 fines amounting RON 30,000 for using radio frequencies without a licence or for non-compliance with the technical and operational parameters of the radio stations.

Radio equipment market and electromagnetic compatibility

In the radio equipment and electromagnetic compatibility (EMC) market, ANCOM carried out 1,068 control actions, applying 346 warnings and 122 contravention fines totalling RON 517,000. The highest fine amounted RON 45,000 and it was applied for holding and using jammer equipment.

Concerning the EMC domain, the highest fine - i.e. RON 20,000 - was applied for placing on the market devices that were not designed and manufactured in accordance with the essential requirements.

Postal service market

In 2021, ANCOM conducted 568 control actions, following which it applied 110 warnings and 65 contravention fines amounting RON 318,000. A frequently found breach in this market was failure to observe the obligations imposed by the general authorisation regime. 

The National Company Romanian Post (CNPR) was subject to 4 of all these control actions, in its capacity as a universal service provider, and was applied a fine amounting RON 5,000 for failure to comply with the minimum quality requirements for domestic items of correspondence within the scope of universal service.

The main breaches assessed were the provision of postal services without an authorisation, failure to deliver postal items by the corresponding means, failure to observe the content of the advice on delivery or of the delivery notice cards and failure to mark/print the postal items.
